Terms of Service
Welcome to Dragon's Claw Cards ("we", "us", "our", "the Site", "the Platform"). These Terms of Service ("Terms") form a legally binding contract between you and Dragon's Claw Cards. By creating an account, listing an item, placing an order, or otherwise using the Site, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy, Refund & Return Policy, and Shipping Policy, each of which is incorporated by reference.
To use Dragon's Claw Cards you must:
You are responsible for all activity on your account, including any actions taken by anyone you give access to. Keep your password and login methods secure. Notify us immediately at support@dragonsclawcards.com if you suspect unauthorized use.
One account per person. Don't impersonate anyone, don't share accounts, and don't create new accounts to evade a suspension or ban. We may verify identity, request government ID through Stripe's identity-verification flow, suspend, or terminate accounts that use false names, fraudulent payment methods, or stolen identity. Suspending one account may also block any other accounts associated with the same person, payment instrument, device, or IP.
You can request account deletion at any time from the Account Settings page. We delete personal data within 30 days of a verified deletion request, except records we are required to retain by law (financial records, tax records, dispute logs, fraud-prevention records — typically 7 years).
You agree not to:
Violations result in listing removal, warnings, suspension of your account or seller account, payout holds, permanent ban, and (where appropriate) referral to law enforcement, the carrier, the payment processor, or applicable trademark holders — at our sole discretion.
Sellers are responsible for the accuracy of every listing they post. Buyers are responsible for reading the listing carefully before purchasing.
An order is accepted when the seller's Stripe Connected Account receives the destination charge. We may decline, cancel, or hold orders that we suspect are fraudulent, that violate these Terms, or that involve a Sanctioned Party. Cancelled orders are refunded in full.
Two fees apply to each completed sale and are deducted automatically from the seller's payout:
The two fees above are itemized separately in your seller dashboard so you can see exactly where each cent goes. The marketplace fee is what Dragon's Claw Cards keeps to operate the Site, fund development, and provide customer support, dispute mediation, and trust & safety operations. The payment-processing fee passes through to Stripe — we do not keep any portion of it. This pass-through model is standard across e-commerce marketplaces.
Promote a Listing is an optional paid add-on. Pricing is calculated based on listing price, boost level, and duration, shown in-app before activation. The promotion fee is charged at activation time and is separate from the marketplace fee on any eventual sale. Promotions are non-refundable once active.
Payouts are released to the seller's connected Stripe account on a schedule that depends on account tier:
Tier changes happen automatically as your sales history grows. We may impose per-listing price caps and daily-sales caps based on tier — these are documented in the seller dashboard and may be adjusted to manage platform risk.
We may extend the payout hold, freeze pending balance, or suspend payouts entirely in cases of disputed transactions, suspected fraud, repeated buyer complaints, account-takeover signals, sanctions screening hits, or regulatory inquiry, at our reasonable discretion.
If your seller account develops a negative balance (e.g., refunds or chargebacks exceed pending payouts), Stripe will attempt to collect from your linked bank account. If Stripe collection fails, the negative balance becomes a debt you owe Dragon's Claw Cards directly. We may pursue collection through any lawful means as described in Section 14 (Indemnification).
All amounts on the Site are in U.S. dollars (USD). Fees are exclusive of any taxes that may be owed by you on your earnings — see Section 6 (Taxes).
All fees are subject to change. Material fee changes will be announced with at least 14 days notice via in-app banner and via email to active sellers. Continued use of the Site after the change date constitutes acceptance of the new fees.
Sellers receive payouts through Stripe Connect using Stripe Connected Accounts (Express). To list items for sale, you must complete Stripe's hosted onboarding flow, which collects identity, business, and bank information directly by Stripe.
By creating a Stripe Connected Account through Dragon's Claw Cards, you agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. These are separate contracts between you and Stripe; we are not a party to them. You authorize Dragon's Claw Cards to share information about you with Stripe, and to receive information from Stripe about your account, in order to operate the marketplace.
Stripe may require additional information from you (government ID, tax ID, beneficial-ownership info, etc.) at onboarding or later for KYC, anti-money-laundering, or risk reasons. Until Stripe approves your account, payouts may be withheld and listings may be limited or hidden.
You may not use a Stripe Connected Account onboarded through Dragon's Claw Cards to process payments outside the Dragon's Claw Cards platform.
You are solely responsible for determining, collecting, reporting, and remitting any taxes that apply to your activity on the Site, including income tax on your earnings, self-employment tax (if applicable), and sales/use tax to the extent you are obligated to collect it.
We do not provide tax advice. Consult a tax professional with questions about your situation.
Sellers choose the shipping mode at listing time (free, flat-rate, calculated at checkout, or local pickup). Once an order is paid, the seller is responsible for purchasing a shipping label and shipping the item within the stated handling window.

If something goes wrong with a purchase:
Auto-refund: if a seller doesn't ship within 14 days of payment, the order is refunded automatically with no action required from the buyer.
Chargebacks: please use our dispute process first — it's faster (hours, not weeks), avoids chargeback fees, and doesn't damage either party's account standing. Chargebacks filed outside our process without first attempting platform resolution may result in buyer account suspension if the chargeback is determined to be invalid under Buyer Protection. If a buyer's bank rules in our favor on a chargeback, the disputed funds are restored to the seller and any chargeback fees may be passed through to the buyer.
Repeat-chargeback buyers may have their account permanently banned and may be required to pay by a non-reversible method for any future activity.

Local trades on Dragon's Claw Cards facilitate in-person card swaps. We are not a party to local trades. We do not hold, escrow, insure, ship, or financially guarantee any cards exchanged in a local trade. You agree that any local trade is solely between you and the other user, and that we have no liability for losses, damages, theft, fraud, or harm of any kind arising from the trade or the meetup.
Our role in local trades is limited to: (a) connecting users via in-app messaging, (b) providing a QR-scan meetup verification tool so both parties can mutually confirm the trade happened, and (c) hosting a separate review system for local trades.
Local-trade reviews are distinct from verified-purchase reviews and show as a separate counter on seller profiles. Reviews from manually-confirmed (non-QR-verified) trades are held for admin moderation. We use rate-limits and abuse detection (mutual-review loops, new-account throttles, IP/device clustering) to deter farming, but cannot guarantee every local review is legitimate. Use the verified-purchase rating and account history as your primary trust signals.
Safety: always meet in a safe, well-lit, public location — preferably a local card shop, a "Safe Trade Zone" at a police station, or a major retailer parking lot during business hours. Bring a friend. Verify cards in-hand using a loupe and (where applicable) a black light. Never agree to off-site meetups or wire payments before exchange.
You retain ownership of any content you upload — including listing photos, listing descriptions, profile information, messages, vault snapshots, reviews, and other user-generated content (collectively, "User Content"). By uploading, you grant Dragon's Claw Cards a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for technical reasons such as resizing or transcoding), publicly display, and distribute that content as necessary to operate, promote, and improve the Site.
You represent and warrant that you own the rights to all User Content you upload, or that you have permission to use it, and that the content does not infringe on any third party's intellectual-property, privacy, or publicity rights.
We may remove, restrict, or anonymize any User Content that we believe in good faith violates these Terms, applicable law, or the rights of third parties.
Reviews you leave about another user must be truthful and based on your actual experience. We may remove reviews that are off-topic, abusive, contain personal information, are part of an extortion scheme ("change the listing or I'll leave 1 star"), or that we determine to be inauthentic.
The following may not be listed or sold on Dragon's Claw Cards:
We reserve the right to remove any listing for any reason or no reason. Repeat violations result in seller account suspension or permanent ban.
The Site, its underlying software, branding, trademarks, logos, and original content are owned by Dragon's Claw Cards or its licensors and are protected by U.S. and international intellectual-property law. Except for the limited license to use the Site granted to you in these Terms, nothing here transfers any IP rights to you.
Trading-card games and the cards themselves remain the property of their respective owners (e.g., The Pokémon Company, Wizards of the Coast, Konami, Bandai, Disney, Bushiroad). Dragon's Claw Cards is not affiliated with, endorsed by, sponsored by, or otherwise officially connected to any of those companies. Card images, set names, character names, and other trademarks are used for nominative descriptive purposes (i.e., to describe the actual cards being bought, sold, or tracked) and remain the property of their respective owners.
If you believe content on the Site infringes your copyright, send a notice to dmca@dragonsclawcards.com with the following information (per 17 U.S.C. § 512(c)(3)):
We will remove or disable access to material that is the subject of a valid notice and notify the user who posted it. Repeat infringers will have their accounts terminated. Counter-notices may be submitted to the same email by the affected user.
The Premium membership is $9.99 per month USD, billed by Stripe to the payment method on file. Premium benefits include a reduced marketplace fee (7% with a $50 cap instead of 10% with a $75 cap), wishlist alerts when matching listings go live, up to 10 vaults instead of 3, priority price refresh quotas, and early access to new features.
Auto-renewal: Premium automatically renews each month on the same calendar day until you cancel. By subscribing, you authorize us (via Stripe) to charge your payment method monthly until cancellation. You can cancel any time from the Account page; you keep all Premium benefits until the end of your current paid billing period, then revert to the Standard tier at the next billing date.
Refunds: Premium fees are non-refundable for partial months. If you cancel mid-month, you keep Premium until period end and are not charged again. We do not pro-rate or refund unused days. Exceptions for material service failures (e.g., extended outage that prevents you from using paid features) are handled case-by-case via support.
Price changes: we may change the Premium price with at least 30 days notice via email and in-app banner. The new price applies at your next renewal — you can cancel before then if you don't want to continue.
California & New York automatic renewal disclosures: by subscribing, you acknowledge that your subscription will automatically renew at $9.99/month, that you authorize Stripe to charge your payment method on each renewal, that you can cancel at any time from the Account page or by emailing support@dragonsclawcards.com, and that we will email you a renewal confirmation receipt for each charge.
The Site is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
Without limiting the foregoing, we do not warrant that:
Limitation of liability: to the maximum extent permitted by law, in no event will Dragon's Claw Cards, its officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, loss of goodwill, or substitute-product cost — arising from or related to your use of the Site, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising from or related to your use of the Site is limited to the greater of (a) $100 USD or (b) the total fees you paid us in the 12 months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Dragon's Claw Cards and its officers, employees, contractors, agents, and affiliates from and against any third-party claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms or any law; or (d) your infringement of any third party's rights.
By selling on this platform, you ("Seller") additionally agree to indemnify, defend, and hold harmless Dragon's Claw Cards from and against any losses, chargebacks, refunds, fees, fines, costs, or legal expenses (including reasonable attorney's fees) caused by your fraudulent, negligent, or non-compliant behavior. This includes, but is not limited to:
If you cause a loss to the platform that is not recovered by Stripe's automatic collection processes, you remain personally liable for the full amount. We may pursue collection through any lawful means, including but not limited to: account suspension, forfeiture of pending payouts, written demand, civil action in small-claims or higher court, referral to a collection agency, and reporting to law enforcement (including the FBI Internet Crime Complaint Center, IC3.gov) where applicable.
Buyers agree to use the platform's built-in dispute system before filing a chargeback with their bank. Chargebacks filed without first attempting platform resolution may result in immediate account suspension. Repeated chargebacks across orders may result in a permanent ban and a requirement that any future purchases be paid by a non-reversible method.
This Section 15 survives termination of your account.
Before initiating any arbitration or court action, you agree to first contact us at support@dragonsclawcards.com with a written description of your dispute and the relief you seek. We will try in good faith to resolve the dispute within 30 days.
If informal resolution fails, you and Dragon's Claw Cards agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site (including disputes about scope, formation, and enforceability of this arbitration agreement) will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as modified here. The arbitration will be conducted in the English language. The arbitrator's award is final and may be entered as a judgment in any court of competent jurisdiction.
You and Dragon's Claw Cards each waive the right to participate in a class action, class arbitration, private-attorney-general action, or any other representative or consolidated proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If a court decides this class-action waiver is unenforceable for a particular claim or remedy, that claim or remedy (and only that one) will be severed from the arbitration and may proceed in court; the remainder of this Section 16 stays in force.
Either party may bring a claim in small-claims court in the county where the defendant resides if the claim qualifies and is brought on an individual (non-class) basis. Either party may also seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual-property rights, prevent unauthorized access to the Site, or enforce confidentiality obligations.
You may opt out of this arbitration agreement by emailing support@dragonsclawcards.com with the subject "Arbitration Opt-Out" within 30 days of first creating your account. Include your name, email on file, and account UID. Opting out does not affect any other part of these Terms.
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Subject to the arbitration agreement in Section 16, any dispute that proceeds in court must be filed exclusively in the state or federal courts located in New Haven County, Connecticut, and you and Dragon's Claw Cards consent to the personal jurisdiction of those courts.
We may suspend or terminate your account, your seller account, or your access to any feature of the Site at any time, with or without notice, if you violate these Terms, if your account presents an unacceptable level of risk (chargeback velocity, fraud signals, sanctions screening hits), if required by law, or for any other lawful reason. We will use reasonable efforts to notify you of suspension or termination unless doing so would interfere with an investigation or compromise the safety of other users.
You may terminate your account at any time via the Account Settings page. Pending orders must be completed (shipped, delivered, or refunded) before account closure. Pending balance held by Stripe will be released according to Stripe's normal payout schedule subject to any required risk hold.
Sections that by their nature should survive termination (including Sections 4 (final amounts owed), 6 (Tax), 10 (Your content license, for content already shared), 12 (IP), 14 (Disclaimers), 15 (Indemnification), 16 (Arbitration), 17 (Governing law), and 20 (Miscellaneous)) survive termination.
We may update these Terms periodically. The "Last updated" date at the top reflects the most recent change. Material changes will be announced with at least 14 days notice via in-app banner and via email to the address on file. Continued use of the Site after the change date means you accept the new Terms. If you don't agree to a change, you must stop using the Site and may close your account.
